Terms of Service

The Edmissa website and platform are operated by Byte Forge Technologies L.L.C ("Byte Forge", "we", "us"), a company registered in Dubai, United Arab Emirates. These Terms of Service ("Terms") govern your access to and use of the Edmissa website and platform (together, the "service"). By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
Paid use of the platform may also be governed by a separate written agreement between you and Byte Forge. Where such an agreement exists, it prevails over these Terms for the subject matter it covers.
Acceptance of these terms
By accessing or using the service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you use the service on behalf of an organisation (for example, an education agency), you represent that you are authorised to bind that organisation, and "you" includes that organisation.
Eligibility and authority
You must be at least 18 years old and able to form a legally binding contract to use the service. The service is intended for education agencies and their staff, not for the general public or for children.
The service
Edmissa is a platform that helps study-abroad agencies capture leads and manage student applications. We may add, change, or remove features over time. Paid access to the platform is provided under a separate order or service agreement; where no such agreement exists, these Terms govern your use of the public website and any access we grant you.
Accounts and security
You may need an account to use parts of the service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use. We may suspend or disable accounts that we reasonably believe have been compromised or used in breach of these Terms.
Acceptable use
You agree not to:
- use the service in violation of any applicable law or regulation;
- upload or process data without the legal right or consent to do so;
- attempt to gain unauthorised access to the service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the service;
- reverse-engineer, decompile, or attempt to extract the source code of the platform, except to the extent permitted by law;
- introduce malware or any other harmful code;
- use the service to send unsolicited communications or to infringe the rights of others; or
- resell, sublicense, or make the service available to third parties except as expressly permitted.
Customer data and responsibilities
You retain ownership of the data that you and your users submit to the platform ("customer data"), including student and applicant data. As between you and Byte Forge, you are the data controller for customer data and Byte Forge is the data processor. You are responsible for the accuracy and lawfulness of customer data and for having a valid legal basis — including any required consents — to collect it and to have us process it on your behalf. Intellectual property
The service, including its software, design, text, and trademarks, is owned by Byte Forge or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the service for your internal business purposes. You may not use our names, logos, or branding without our prior written consent. If you give us feedback or suggestions, you grant us a non-exclusive, royalty-free licence to use them to improve the service.
Fees and payment
Pricing, billing, and any service levels for paid use of the platform are set out in the separate order or service agreement between you and Byte Forge. We do not collect payment through this website. Where a signed agreement applies, its commercial terms govern; these Terms continue to apply to your general use of the service.
Third-party services
The service may link to or integrate with third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk and subject to their terms.
Confidentiality
Each party may have access to the other's confidential information. Each party agrees to protect the other's confidential information with reasonable care and to use it only as needed to exercise its rights or perform its obligations under these Terms, except where disclosure is required by law.
Warranties and disclaimers
We provide the service with reasonable skill and care. Except as expressly stated, the service is provided "as is" and "as available", and to the fullest extent permitted by law we disclaim all other warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
Limitation of liability
To the fullest extent permitted by law, Byte Forge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the service. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Indemnification
You agree to indemnify and hold Byte Forge harmless from any claims, losses, or expenses arising from your customer data, your use of the service, or your breach of these Terms, except to the extent caused by our own breach or negligence.
Term and termination
These Terms apply while you use the service. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service or other users. You may stop using the service at any time. On termination, the rights granted to you end; provisions that by their nature should survive — such as intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification — will survive. Changes
We may update these Terms from time to time. If we make material changes, we will update the "last updated" date above and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The courts of Dubai have exclusive jurisdiction over any dispute arising from or relating to these Terms or the service.
General
These Terms, together with any applicable signed agreement, are the entire agreement between you and Byte Forge regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
